Another update from the lawyer's office:
Two depositions will be held next week on the 19th:
Dr. Nagappan - the surgeon who took over for Takei
for the last couple of weeks
Dr. Saab - Darrel's original
hematologist/oncologist - He is the doctor that was treating Darrel's blood
problem for years and finally convinced Darrel that he should have the spleen
removed so he could get off of the Prednisone. I didn't know that they had
subpoenaed him.
And there will be more expert witness depositions
in the next 2 to 3 weeks.
The summary judgement scheduled for Wednesday, May 20, has been taken off
the calendar.
They got an "expert declaration" that the there was enough merit to go to
trial.
That means that if there is not a settlement before June 16, we will go to
trial.
If there is an older case that is ready to go to trial at that time, we
could still be taken off the calendar as late as a week before. I have a feeling
that, even if we would win the case, Takei was file an appeal and this could go
on for a long time.
So we wait and see.
